Timing: The Contest
begins on May 6, 2022 at 1:00 a.m. Eastern Time ("ET") and ends on
May 16, 2022 at 11:59 p.m. ET (the "Contest Period"). Tik Tok, Inc.’s
servers are the official time-keeping devices for the Contest.
5. How to Enter:
Participation Requirements: To participate, Nominators will need to
have a public TikTok account. Creating a TikTok account is free but is subject
to its terms and conditions. If entering via a mobile device
and using your wireless carrier’s network, standard data charges from your
wireless carrier may apply.
Entry Requirements: During the Contest Period, Nominators must take the following actions to
receive an entry:
(a) Follow @royalcaribbean
on TikTok and make sure that your privacy account settings allow for Friends to
direct message you;
(b) Create a video nominating a Nominee (the “Nomination Video”). Your Nomination
Video must show why your Nominee is a “WonderMom,” and
must include the sound available through the hashtag challenge page. See below
for additional guidelines,
permissions, and content restrictions of Nomination Video.
(c) Upload your Nomination Video to TikTok and include @royalcaribbean and
#SearchForWonderMom #Contest in your original caption.
(d) Your account
settings must remain public and allow for Friends to direct message you during
the Contest Period and until the prizes are awarded (as described in Section 7);
and
(e) You must
not change your TikTok handle during the Contest Period and until the prizes are
awarded (as described in Section 7).
Guidelines:

The
Submission must meet the format and size requirements of TikTok as well as those
of the Entry Requirements above; and
·
The
Submission must be in English.
Permissions: Nominator must have
permission from their Nominee as well as any recognizable individuals who appear
in the Submission to use their names and likenesses in the Submission and to
grant the rights set forth herein. Minors may only be included in the Submission
if Nominator is their parent or legal guardian. If requested, Nominators must
be able to provide such permissions or proof in a form acceptable to Sponsor.
Content Restrictions:
· The Submission must be
your original work;
·
The
Submission must not convey any claims of Sponsor’s products or services that would
be deemed unsubstantiated or deceptive if made by Sponsor;
· The Submission must not
contain material that violates or infringes another’s rights, including but not
limited to privacy, publicity or intellectual property rights, or that
constitutes copyright infringement;
o
Accordingly,
Submission must not contain brand names or trademarks other than those owned by
Sponsor; and
o
Submission
must not contain content created by a third party, such as music (other than the
provided campaign music track), images or artwork;
· The Submission must not
disparage Sponsor, or any other person or party;
·
The
Submission must not promote or reference alcohol, illegal drugs, tobacco, or
firearms/weapons, any activities that are or appear to be dangerous, or any
political agenda;
· The Submission must not
contain material that is inappropriate, offensive, indecent, obscene, sexually
explicit, tortious, defamatory, slanderous or libelous;
· The Submission must not
contain material that promotes bigotry, racism, hatred, or harm against any
group or individual or promotes discrimination based on race, gender, religion,
nationality, disability, sexual orientation, or age; and
· The Submission must not
contain material that is unlawful, in violation of, or contrary to the laws or regulations
in any state where Submission is created.
By
uploading your Nomination Video on TikTok and following all of the requirements
listed above (herein your “Submission”), you will receive one (1) entry into the
Contest. In addition, any attempt by any Nominator or Nominee to obtain “Likes,”
“Views” or “Shares” of the Submission by any fraudulent, unfair, or
inappropriate means, including without limitation, by offering prizes or other
inducements to members of the public as determined by Sponsor in its sole
discretion, will void their score as it relates to “Public Engagement” (see
Section 7 below) and Nominator may be disqualified as determined by Sponsor in
its sole discretion. Sponsor, in its sole discretion, may remove
your Submission from its TikTok Challenge page, and disqualify you if it believes
that it fails to conform.
6.
Sponsor's Use of Submissions: Posting a Submission constitutes Nominator’s
consent to give Sponsor a royalty-free, irrevocable, perpetual, non-exclusive
license to use, reproduce, modify, publish, create derivative works from, and
display such submissions in whole or in part, on a worldwide basis, and to incorporate
it into other works, in any form, media or technology now known or later developed,
including for promotional or marketing purposes. Nominator may not consent to
give any other person or party a license to use the Submission; However, Nominator
will continue to own the Submission. If requested, Nominator will sign any documentation
that may be required for Sponsor or its designees to make use of the non-exclusive
rights Nominator is granting to use the Submission.
7. Winner Determination & Requirements: After the Contest Period, a panel of
qualified judges, determined by Sponsor in its sole discretion, will select the
five (5) highest-scoring Submissions from among all eligible Submissions based
on the following criteria (“Judging Criteria”):
Subject to the Nominator’s and Nominee’s compliance with
these Official Rules (see additional requirements below), the five (5) Nominees nominated by the five
(5) highest scoring Submissions will be the “Potential Winners.” In the event of a tie, the Nominee nominated by
the Submission that received the highest score for "Emotional Impact of the Submission" as determined by the qualified judges in their sole
discretion, will be deemed the applicable Potential Winner from
amongst the tied Submissions. Sponsor reserves
the right to select fewer than five (5) Potential Winners, if, in its sole discretion,
it does not receive a sufficient number of eligible and qualified Submissions. Sponsor
will not disclose judging scores.
On or around June 2, 2022, the five (5) Nominators
of the highest scoring Submissions (“Potential Winning Submissions”) will be
notified by @royalcaribbean on TikTok (the
“Notification”). Each Nominator will be directed to a secure online portal
and will be required to provide Nominator’s contact information within 2 days of
the date of Notification. Nominator will receive an email where they will be
required to provide contact details for their Nominee. Next each Nominee/Potential
Winner will be required to sign and return prize acceptance documents where
they (a) confirm that they meet eligibility requirements, (b) agree to abide by
these Official Rules, including signing a Publicity Release and agreement to the
tax consequences of accepting the prize, (c) agree to a confidential background
check, (d) agree to a video screening interview with Sponsor (dates/times to be
determined by Sponsor), and (e) if selected as the Grand Prize Winner agree to participate
inaugural ceremony and sailing December 9 -11, 2022 (“the Ceremony”) and sign a
partnership agreement with Sponsor. Each Potential Winner must compete and
return these documents to Administrator within four (4) days of the date notice
or attempted notice is sent, to claim the prize. If a potential winner of any
prize cannot be contacted, fails to sign and return
the prize acceptance documents within the required time period, or the prize is
returned as undeliverable, the potential winner forfeits the prize. If the
background check reveals that a potential winner has engaged in conduct that
could damage the reputation of Sponsor or any of the Released Parties, as
determined by Sponsor in its discretion, Sponsor may disqualify potential
winner.
Upon confirmation that Nominee has
passed the background check, representatives of the Sponsor will set up a one-hour
video interview with each Potential Winner. The purpose of this interview is to
make proper introductions between each Potential Winner and the Sponsor and
give each Potential Winner an opportunity to share why they would like to hold
the title and honor of being the Godmother of Royal Caribbean’s Wonder of the
Seas. After the interview process, Sponsor
will select the Grand Prize winner from among all Potential Winners that were
interviewed based on their assessment of which Potential Winner will be the
best representative of Sponsor. After
the conclusion of all interviews, each Potential Winner will be advised of the prize
that they have won. If a potential
winner is disqualified for any reason, the prize may be awarded to a runner-up, if any, in Sponsor’s sole
discretion. Only three (3) alternate
winners may be determined, after which the applicable prize will remain
un-awarded.
8. Prizes: ONE (1) GRAND PRIZE: Grand Prize Winner will be awarded the title of Godmother
of the Wonder of the Seas cruise ship and will be required to sign a
partnership agreement including the requirement that winner attend the Ceremony,
and sailing on December 9 -11, 2022, departing from Port Canaveral, Florida. Sponsor
will provide round trip airfare for winner ONLY to and from an airport located
near winner’s home to Orlando, FL (all details of flight and suite to be determined
by Sponsor and a suite onboard the ship where the Ceremony will take place for
winner ONLY. Grand Prize Winner may
bring a guest to this Ceremony, at winner’s expense.
Grand
Prize Winner will receive Wonder's Ultimate Family
Suite (or any Star Class Suite onboard Wonder of the Seas) onboard a seven (7) night sailing (“Sailing”) for
Grand Prize Winner and up to five (5) eligible guests, fulfilled as a Cruise
Certificate (terms and conditions of the prize offered will be included on the
certificate, including but not limited to expiration date, and blackout dates).
Certificate must be redeemed and used by within one (1) year of the date of its
issuance or prize will be forfeited. Trip package includes round trip, first
class transportation for up to six (6) from a major airport located near winner’s
home (determined by Sponsor in its sole discretion) to Orlando, FL; ground
transportation services from airport to hotel, hotel to port and port to
airport; three (3) nights hotel accommodations (up to 3 rooms double occupancy);
$1,000 in credit redeemable for services onboard the cruise; and $1,000 spending
money and $34,850 (that may be used to assist with tax liability), (all fulfilled
as a check). There exists an inherent risk of exposure to COVID-19 in any public
place where people are present. COVID-19 is a contagious disease that can lead
to severe illness and death. By traveling and attending event, winner and
winner’s guests voluntarily assume all risks related to exposure to COVID-19.
All sailing guests must comply with any health protocols or requirements we may
have at the time of their sailing. Updated info can be located here.
Trip must be booked at least thirty (30) days prior to
departure and Sponsor cannot guarantee that all six (6) travelers will be
seated in first class due to the limited number of seats. Sponsor will determine
flight itinerary in its sole discretion. No refund or compensation will be made
in the event of the cancellation or delay of any flight. Travel is subject to
the terms and conditions set forth in this Contest and those set forth by the
Sponsor’s airline provider of choice. All expenses and
incidental travel costs not expressly stated in the package description above,
including but not limited to, ground transportation, meals, incidentals, gratuities,
passenger tariffs or duties, airline fees, surcharges, airport fees, service
charges or facility charges, personal charges at lodging, security fees, taxes
or other expenses are the responsibility solely of winner. Unless child of Grand Prize Winner or child
of another guest, all guests must be eighteen (18) years of age or older as of
the date of departure and must travel on same itinerary and at the same time as
the winner. Grand Prize Winner and guests are responsible for procuring
all necessary travel documentations they will need in order to sail. Guests must execute liability/publicity releases prior to
issuance of travel documents. Travel restrictions, conditions and limitations
may apply. Grand Prize Winner and travel companions are responsible
for complying with any COVID-19 requirements set forth by private airline, hotel,
cruise line, excursion and event venues or other vendors offering services that
are part of the trip prize. Failure to comply with any required COVID-19 requirements,
may result in forfeiture of the prize of elements of the prize. Forfeiture of any aspect of the trip due to failure
to meet these requirements will not impact the value of the trip as reported on an IRS Form 1099.
If in the judgment of Sponsor air travel is not required due to Grand
Prize Winner’s proximity to prize location, ground transportation will be
substituted for round trip air travel at Sponsor’s sole discretion. Sponsor will not replace any lost, mutilated, or stolen
tickets, travel vouchers or certificates. Sponsor is not responsible if Ceremony
is delayed, postponed, or cancelled for any reason, in which that portion of
prize is forfeited in its entirety and no substitution will be provided except
as in Sponsor’s sole discretion. Approximate Retail Value (“ARV”): $116,200.
FOUR (4) FIRST PRIZES: Each First Prize Winner will be awarded a seven (7) night Royal Caribbean cruise on
Wonder of the Seas for First Prize Winner and up to three (3) eligible guests, fulfilled
as a Cruise Certificate that provides all terms and conditions of the prize
offered including but not limited to expiration date, and blackout dates. Certificate
must be redeemed and used within one (1) year of the date of its issuance or
prize will be forfeited. Winner is solely responsible for roundtrip travel and accommodations
required to get to the departure port. There exists an inherent risk of
exposure to COVID-19 in any public place where people are present. COVID-19 is
a contagious disease that can lead to severe illness and death. By traveling,
winner and winner’s guests voluntarily assume all risks related to exposure to COVID-19.

For All Prizes: Winners will not receive
difference between actual and approximate retail value. Prize is non-transferable, and no substitution will be made except
as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right
to substitute the prize (or a component thereof) for one of equal or greater
value if the designated prize should become unavailable for any reason. Winners are responsible for all taxes
and fees associated with prize receipt and/or use. Limit: One (1) prize
per person. Cruise Certificates will be
fulfilled 8 – 10 weeks after the end of the Contest. Other prize components may be issued at the
time of travel.
9.
Release: By receipt of
any prize, each Winner agrees to release and hold harmless the Sponsor, TikTok
Inc., Administrator, and their respective parent companies, subsidiaries,
affiliates, suppliers, distributors, advertising/promotion agencies, and prize suppliers,
and each of their respective parent companies and each such company’s officers,
directors, employees and agents (collectively, the “Released Parties”) from and
against any claim or cause of action, including, but not limited to, personal
injury, death, or damage to or loss of property, arising out of participation
in the Contest or receipt or use or misuse
of any prize, including any related travel.
10. Publicity Acceptance
of any prize shall constitute and signify each Winner’s agreement and consent
that Sponsor and its designees may use the Winner’s name, city, state, likeness,
photo, including winner’s TikTok profile photo, Submission, and/or prize
information in connection with the Contest for promotional, advertising or other
purposes, worldwide, in any and all media now known or hereafter devised,
including the Internet, without limitation and without further payment,
notification, permission or other consideration, except where prohibited by
law.
11.
General Conditions: Sponsor reserves the right to cancel, suspend and/or modify
the Contest if any fraud, technical failures, human error, any other factor
impairs the integrity or proper functioning of the Contest, or any event or cause
beyond Sponsor’s control (e.g. events such as natural calamities, national emergencies,
wide spread illnesses, declarations of war, acts of God, acts of terrorism) interferes
with any aspect of the Contest, including but not limited to fulfillment of the
prize(s), as determined by Sponsor in its sole discretion. If terminated, Sponsor may, in its sole discretion, determine
the winner(s) from among all non-suspect, eligible Submissions received up to
time of such action using the judging procedure outlined above. Sponsor may also modify the
prizes offered. In addition, Sponsor reserves the right to disqualify any
individual it finds to be tampering with the entry process or the operation of
the Contest or to be acting in violation of the Official Rules of this or any
other promotion or in an unsportsmanlike or disruptive manner and void all associated Submissions. Any
attempt by any person to deliberately undermine the legitimate operation of the
Contest may be a violation of criminal and civil law, and should such an
attempt be made, Sponsor reserves the right to seek damages and other remedies (including attorneys’ fees)
from any such person to the fullest extent permitted by law. Sponsor’s failure
to enforce any term of these Official Rules shall not constitute a waiver of
that provision.
12. Limitations of Liability: Released
Parties are not responsible for: (1) any incorrect or inaccurate information,
whether caused by Nominator, printing, typographical or other errors or by any of the equipment or programming
associated with or utilized in the Contest; (2) technical failures of any kind,
including, but not limited to malfunctions, interruptions, or disconnections in
phone lines or network hardware or software; (3) unauthorized human intervention
in any part of the Submission process or the Contest; (4) printing, typographical, technical, computer,
network or human error which may occur
in the administration of the Contest, the uploading,
the processing or judging of
Submissions, the aggregation of Likes, Views and Shares from TikTok, the announcement
of the prizes or in any Contest-related materials; (5) late, lost, undeliverable, damaged or stolen mail; or
(6) any injury or damage to persons or property which may be caused, directly
or indirectly, in whole or in part, from Nominator’s participation in the
Contest or receipt or use or misuse of any prize (including any travel/activity related thereto). Released
Parties are not responsible for
misdirected or undeliverable Submissions or for any technical problems, malfunctions of computer
systems, servers, providers, hardware/software, lost or unavailable network
connections or failed, incomplete, garbled, or delayed computer transmission or
any combination thereof. Released Parties are not responsible for any unauthorized third-party use of any Submission.
13. Disputes: Except where
prohibited, each Nominator agrees that: (1) any and all disputes, claims and
causes of action arising out of or connected with this Contest or any prize awarded shall be resolved individually, without resort
to any form of class action, and exclusively by the United States District Court
for the Eastern District of Michigan or the appropriate Michigan State Court
located in Oakland County, Michigan; (2) any and all claims, judgments and
awards shall be limited to actual out-of-pocket costs incurred, including costs
associated with entering this Contest, but in no event attorneys’ fees; and (3)
under no circumstances will Nominator be permitted to obtain awards for, and Nominator
hereby waives all rights to claim, indirect, punitive, incidental and
consequential damages and any other damages, other than for actual out-of-pocket
expenses, and any and all rights to have damages multiplied or otherwise
increased. All issues and questions concerning the construction, validity, interpretation
and enforceability of these Official Rules, or the rights and obligations of
the Nominator and Sponsor in connection with the Contest, shall be governed by,
and construed in accordance with, the laws of the State of Michigan without giving
effect to any choice of law or conflict of law rules (whether of the State of
Michigan or any other jurisdiction), which would cause the application of the
laws of any jurisdiction other than the State of Michigan.
